Dear Michelle,

 

Thank you for sending me the applicant’s late submissions. I have now had the chance to take instructions from the Soho Society, and thought it would be helpful to make the parties and Members aware of their position prior to the hearing.

 

The Soho Society welcome and encourage successful independent businesses in Soho, and have no issues with the operation of the premises.

 

The Soho Society’s representation focused on paras 2.4.17-2.4.22 of the City Council’s Statement of Licensing Policy. These paragraphs posit a policy approach for premises which do not fall easily within the definition of RNT2, PB2 etc. Salon 64 is one such premises. These policies effectively state that if certain criteria are met (as appropriate, depending on the specifics of an application), then the licensing authority may agree that sale of alcohol in the CIA may not add to cumulative impact.

 

Foremost among these criteria is a terminal hour of 8pm. This is seen, in Policy terms, to provide retail establishments with some flexibility to provide an additional service to their customers, whilst not impinging on the hours in the mid-to-late evening when it is more likely that such customers will add to ‘cumulative impact’.

 

The Soho Society’s view is that consistency in the application of such policies is of vital importance if the robustness of the Policy is to maintained. It is noted that similar types of establishment have applied for licences and been granted 8pm. One example is ‘Blade’ on Frith Street. This premises applied in 2015 for a licence to sell alcohol to their customers, and also as part of a ‘private members’ type club similar to what is proposed in the present application. Blade were granted a licence for both, to 8pm.

 

It is noted that Salon 64 currently only have permission to sell alcohol to customers, not to members of the private club. Accordingly, the Soho Society would not oppose the grant of a variation to Salon 64’s licence to allow the operation of a ‘private members’ style club until 8pm. They do not, however, agree that the applicant has justified an extension beyond this time, and are mindful of the precedent this may set for other similar establishments.

 

I attach a copy of the ‘Blade’ decision for information.
